Terms of Service

These Terms of Service ("Terms") govern your access to and use of Superdm ("Service"), operated by Dhiraj Dattatray Kadam, India. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) and have the authority to manage the Instagram account(s) you connect.

2. Your account

You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised use.

3. Instagram & Meta platform

Superdm interacts with Instagram via Meta's Graph API. Your use of the Service is also subject to Meta's Instagram Terms and Platform Terms. You must not use the Service in a way that violates those terms or any applicable rate limits, anti-spam policies, or content policies. You grant us permission to act on your Instagram account only to the extent required to deliver the features you have configured.

4. Acceptable use

You agree not to:

• Send spam, harass, or contact users without a legitimate basis.
• Impersonate any person or misrepresent your affiliation.
• Use the Service to distribute malware, illegal content, or anything that violates third-party rights.
• Reverse engineer, scrape, or attempt to disrupt the Service.
• Resell or sublicense the Service without our written consent.

5. Content

You retain ownership of the messages, flows, and configurations you create. You grant us a limited licence to host and process this content solely to operate the Service for you. You are solely responsible for the messages sent on your behalf and for compliance with applicable laws (including consumer-protection, privacy, and marketing laws such as GDPR, CAN-SPAM, and TCPA where relevant).

6. Fees

Where the Service offers paid plans, fees, billing terms, and refund policies will be presented at sign-up. Taxes are your responsibility unless stated otherwise.

7. Termination

You may stop using the Service and delete your account at any time — see our Delete Account page. We may suspend or terminate your access if you breach these Terms, if required by Meta, or if continued provision of the Service is not commercially viable. Sections that by their nature should survive (ownership, disclaimers, limitation of liability) survive termination.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that messages will always be delivered.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUPERDM AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) USD 50.

10. Indemnity

You will indemnify and hold harmless Superdm and its affiliates from any claims arising out of your use of the Service, your content, or your violation of these Terms or applicable law.

11. Changes

We may modify these Terms from time to time. We will provide notice of material changes. Continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of India, without regard to its conflict of law principles. Any dispute will be subject to the exclusive jurisdiction of the courts located in Pune, India, unless mandatory local law provides otherwise.
